James Ian Sherrill was sentenced for pulling a gun on a fellow parent following a soccer match. His children’s soccer match ended in confrontation, when Mr Sherrill felt threatened and a pulled his legally-concealed pistol. This apparently ended the confrontation. Mr. Sherrill then immediately went to the local police station to report the incident.

Read the Article from Mlive.

The overall result is a sentence to felony charges of assault with a dangerous weapon, to which Mr. Sherrill pleaded no contest. The sentence is 30 days in jail, along with some fines and costs, as well as probation.

There are several important lessons here for us folks that believe in the 2nd Amendment right to carry firearms.

1. Brandish a firearm only as a last resort. Somebody must be physically in peril and need the assistance of deadly force.

2. Recorders will prove your case and the amount of physical danger when/if self defense measures need to occur. It will be much easier to prove your case if you have a recording of exactly what happened. This was not a jury trial, but merely a prosecutor and judge deciding how to handle this.

3. The actions of single individuals affect the perception of entire groups of people. All concealed-carry permit holders come under scrutiny after this incident. Viewpoints from the comments on this story reflect the poor views on those that conceal carry.

Many kudos to the individual for taking personal responsibility for his actions. Mr Sherrill immediately made his way to the police station to make a report, definitely not know where things would lead. He made himself a great example as a father and concealed carry holder for taking responsibility for the situation that occurred.

The ruling on Monday, June 28, 2010 by the US Supreme Court in the case of McDonald v Chicago is historic and important. The 5-4 decision in favor of the individual right to keep and bear arms was an important upholdance of the Bill of Rights of the Constitution of the United States of America.

Many people rightly have concern about the four dissenting votes in this case. Rightly so. We seem to have four Justices at the highest level of the Judicial Branch of the U.S. government that do not interpret the Second Amendment to mean that individuals have the right to own firearms to protect and defend.

My first thought on hearing of this close decision was this:

“What if the ruling had gone the other way?”

What would the reaction of the pro-gun rights crowd be? Of course it would be peaceful, though the media might warn of cases of violence. I do not believe that this ruling would have been “The straw that broke the camel’s back.”

I am an optimist, and I believe that a ruling in favor of the City of Chicago’s gun ban would have strengthened the pro-gun rights movement. The election of President Obama was a large awakening for the movement. Without any direct threat or promise, many feared a change in the White House would greatly affect their Second Amendment rights. These fears were well founded by facts and previous actions of the President and his men.

This was a close victory for those that believe in the great American right to keep and bear arms. Let us not take this victory for granted and fail to see the other challenges in the future. Many elements of society still want to make it illegal for law-abiding citizens to own firearms with which to defend themselves. They will work any other avenues available.

It is important to consider non-traditional methods of concealing firearms. Off-body concealment of pistols can be beneficial inside personal activity areas such as your home, your garage, your vehicle, and your work when acceptable. Magnetic firearms retainment is a possible solution to your need.

The biggest hurdle is whether your firearm is compatible with a magnet. Plastic guns that do not have a significant metallic frame surface will not work with magnets. Stainless steel is normally a non-metallic as well. There are getting to be many exotic gunframe alloys in use that may be questionable. Full frame high-caliber pistols may be too heavy for magnetic support alone. Testing this out may be the only sure method to identify compatibility.

There are several available options to purchase these from vendors. Or you could just rig something up for yourself. I found a great Youtube video of just such a situation. Called “How to Make a Magnetic Holster,” this video demonstrates just how quick and easy it is to accomplish.

Steve with Safe Arms Review does a great job giving us some valuable information on how to construct a magnetic firearm retention device, what materials are required, and some ideas on where and how to mount it.

This video does not show blood and guts, but demonstrates a lesson to everybody about gun safety. He even appeared to check the chamber and have it verified by another adult present. It still fired into the floor. At least he had it pointed in a safe direction!

Criminals use and possess weapons to use for criminal purposes. The term “weapon” is intended to mean an instrument used to attack a victim. Criminals use these tools to commit violent crime against victims that may or may not be intended.

Law-abiding citizens arm themselves for defense of their person and their loved ones. Firearms, knives, mace, tasers, etc. are used to defend against criminals with intentions of violent crimes. These items used for self defense should not be referred to as weapons, though police and media continue to do so.

The police classify all guns, knives, etc as weapons whether a person is a bad guy or not. The media continue the myth from the police, and spread the fear and terror to their public audience.

The good guys carry guns, firearms, pistols, defensive tools, knives, spray, etc. The bad guys are the ones with the weapons, and the American public needs to continually remind ourselves, the police, and the media of this fact.

Senate bill S.845 and House bill H.R. 197 are currently being considered to assist Concealed Carry Permit Holders to practice their rights in other states. Titled “Respecting States Rights and Concealed Carry Reciprocity Act of 2009,” the bills allow for concealed carry permit holders in the currently-allowed 48 states to carry their firearms in the other states that allow it. Illinois and Wisconsin are the two states that do not allow concealed carry at all.

From Washingtonwatch.com,

“National Right-to-Carry Reciprocity Act of 2009 – Amends the federal criminal code to establish a national standard for the carrying of concealed firearms (other than a machinegun or destructive device) by non-residents. Authorizes a person who has a valid permit to carry a concealed firearm in one state and who is not prohibited from carrying a firearm under federal law to carry a concealed firearm in another state in accordance with the restrictions of that state or as specified under this Act.”

Senator John Thune (R-SD) introduced the Senate legislation, and Rep Stearns (R-FL) and Rick Boucher (D-Va.) sponsored the House legislation. Both bills have numerous co-sponsors, and are moving down the pipeline towards becoming law. This legislation does not create a federal licensing system, still leaving it in the control of the States where it belongs. The federal law will force States to recognize each other’s gun license holders, much like States recognize each other’s drivers license holders.

I recently attended an outdoor picnic celebrating the right to Open Carry in the State of Michigan. This picnic aimed to educate, inform, and connect those interested in the Open Carry of firearms. This law is relatively unknown, but exists in many U.S. States. The laws allow for carrying hip-holstered firearms in the general public. Many exemptions exist, but many places have left it legal to openly display a pistol while walking down the street. There have been many instances of harassment by local police, but these officials are being educated about the actual law.

Local police may harass open carriers with different laws including trespassing, brandishing, and disturbing the peace. Brandishing is the menacingly wave of flourish of a gun, which is more than just having it in a holster and minding your business. The trespassing charge may come from being on private property and being asked to leave by the owners, such as a store or theater. Disturbing the peace charges come when excitement is generated by the appearance of a gun. As long as it is within the law, it is not the owner’s fault if it causes a stir.

The state of Michigan allows citizens over the age of 18, who are law abiding, to openly carry a legally registered handgun in a holster in many areas, with some exemptions in the law for things such as churches, bars, schools, courts, etc. The Michigan law considers firearms in vehicles concealed, so a person must have a Concealed Pistol License to have a loaded gun in their car.

Personal property rules over-ride the state law. This means that if a private property owner objects to a person openly carrying a firearm, the firearm or the person AND the firearm needs to be removed. This will be considered trespassing if the owner’s wishes are not followed.

Openly carrying a firearm requires good knowledge of the law, as it may increase your visibility and lead to increased attention from the public and police.

A great place to find information about these laws is online at http://www.OpenCarry.org Many other resources exist that pertain directly to your state and local areas. These must be well studied and well known before laws are broken and getting yourself into legal trouble.

The gun industry has gotten a windfall from the election of President Obama. Even though there have not been any moves by the Administration to get an Assault Weapons Ban or do other things to limit firearms, there has been a huge buying frenzy for guns and ammunition. Anybody that has tried to get ammo for pistols lately knows that WalMart has had empty shelves for at least the last six months.

Many pistols have long back orders and guns are getting bought up in record numbers. The number of people getting Concealed Weapons Carry permits has been huge as well. Smith & Wesson announced yesterday that their fourth-quarter profit more than doubled as compared to a year ago.

The fear and frenzy of the loss of second amendment rights has helped to educate those who have taken these rights for granted. The fear of not being able to get guns in the future has caused many prior non-gun owners to go out and get educated and purchase a firearm.

The gun industry has had strong sales and awakening from a larger cross section of the public, thanks to the election of President Obama. The threat of losing gun rights has awakened and encouraged a larger awareness among the public.
